Description

This audio program was recorded at the National Institute on the Foreign Corrupt Practices Act 2008.

About the National Institute
With sharply increased enforcement of anti-corruption laws in the United States and abroad, this program provides a timely and substantive briefing on developments in this area of critical importance to companies, their officers and employees. FCPA investigations and enforcement proceedings brought by the Department of Justice and the Securities and Exchange Commission continue to increase dramatically in number and severity. Individuals are prosecuted far more frequently than in prior years. The advent of transnational bribery legislation in more and more countries and the U.S. focus on foreign violators have significantly increased the liability associated with projects and acquisitions in high risk countries. As a result, effective compliance programs and careful due diligence have become vital to protect against violations. This program features experienced government, corporate and private practitioners who regularly deal with issues raised by the FCPA. The Institute provides valuable insights into effective compliance practices including pre-merger and acquisition due diligence, management of anticorruption business risks, conducting internal investigations and dealing with the government's expectations.

Program topics include:
  • A review of recent developments and future enforcement trends
  • A discussion by corporate counsels of the challenges they face in their efforts to comply with the FCPA in a world without economic boundaries.
  • Conducting internal investigations of allegations of corruption
  • The role of monitors in settlements with the Department
    of Justice and the SEC
  • Implementing compliance programs and conducting risk
    assessments
  • Representing Individuals in FCPA Cases.
  • Conducting due diligence on and incorporating compliance terms in contracts with third parties.
